Alliance of Concerned Men (“ACM,” “the Alliance,” “we,” “us,” or “our”) is a nonprofit organization based in Washington, DC, dedicated to violence prevention, intervention, mentoring, credible messenger programming, and community uplift services. These Terms of Service (“Terms”) govern your access to and use of allianceofconcernedmen.org, together with all content, features, and functionality made available on or through it (collectively, the “Website” or “Site”).
These Terms constitute a legally binding agreement between you and ACM. Please read them carefully before using the Site.
1. Acceptance of Terms
By accessing, browsing, or using the Site—including submitting a form, signing up to volunteer, subscribing to our newsletter, or making a donation through the Site—you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must discontinue use of the Site immediately.
If you are using the Site on behalf of an organization, school, agency, or other entity, you represent that you have authority to bind that entity to these Terms.
2. Website Use
The Site is provided to share information about ACM’s mission, programs, leadership, news, and community impact, to facilitate volunteer and partner engagement, and to support fundraising for our charitable work. You may use the Site only for lawful purposes and in accordance with these Terms.
You agree not to:
- Use the Site in any way that violates applicable federal, DC, or local law or regulation;
- Use any automated system, bot, scraper, or data-mining tool to access or collect content from the Site without our prior written consent;
- Attempt to gain unauthorized access to any portion of the Site, other accounts, or connected systems or networks;
- Interfere with, disrupt, or place an undue burden on the Site or the networks or services connected to the Site;
- Use the Site to transmit any virus, malware, or other harmful code; or
- Reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the Site for commercial purposes without our express written permission.
We reserve the right, but have no obligation, to monitor use of the Site and to restrict, suspend, or terminate access for any person who violates these Terms.
3. Eligibility and Use by Minors
The Site is intended for a general audience and is directed at parents, guardians, community members, donors, volunteers, partner agencies, and adults seeking information about ACM’s programs. The Site is not directed at children under 13, and we do not knowingly collect personal information from children under 13 through the Site in the manner regulated by the Children’s Online Privacy Protection Act (COPPA).
Program participants under 18 may be referenced or described (in de-identified or aggregate form) in connection with our youth-serving programs, but enrollment, intake, and participation in ACM’s mentoring, credible messenger, or violence-intervention programs occur offline, through ACM staff, and are governed separately from this Site and these Terms—not through the Website itself. If you believe a child has submitted personal information to us through the Site without appropriate consent, please contact us using the information in Section 22 so we can address it.
4. Intellectual Property
All content on the Site—including text, graphics, logos, the ACM name and marks, photographs, video, program descriptions, and the overall look and feel of the Site—is owned by ACM or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws, unless otherwise noted.
Subject to your compliance with these Terms, ACM grants you a limited, non-exclusive, non-transferable, revocable license to access and view the content on the Site for personal, non-commercial, and informational purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any content from the Site without our prior written consent, except as permitted by applicable law (such as fair use) or as ACM makes available through designated “share” or press-kit features.
The ACM name, logo, and related marks may not be used in connection with any product or service, or in any manner likely to cause confusion, without prior written permission.
5. Copyright Infringement Notification
ACM respects the intellectual property rights of others. If you believe that content on the Site infringes your copyright, please send a written notice to the contact listed in Section 22 that includes: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the material you claim is infringing and its location on the Site; (c) your contact information; (d) a statement that you have a good faith belief the use is not authorized; and (e) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act on behalf of the copyright owner. ACM will investigate and respond to valid notices in accordance with applicable law.
6. User Conduct
Where the Site allows you to submit information—such as, but not limited to, contact forms, volunteer sign-ups, newsletter subscriptions, or comments—you agree to:
- Provide accurate, current, and complete information;
- Refrain from submitting content that is unlawful, threatening, abusive, harassing, defamatory, obscene, or that promotes violence, discrimination, or hatred—conduct that runs contrary to ACM’s mission of nonviolence and community uplift;
- Refrain from impersonating any person or entity or misrepresenting your affiliation with any person or entity; and
- Refrain from submitting confidential, sensitive, or personally identifying information about a third party (including current or former program participants) without that person’s consent.
ACM reserves the right to remove, decline to post, or restrict any submitted content or user, at our discretion and without notice, particularly where content is inconsistent with our mission or these Terms.
7. User Submissions, Testimonials, and Stories
If you submit a testimonial, story, photograph, comment, or other content to ACM (including through email or a form on the Site) for possible use on the Site, in newsletters, or in fundraising and grant-reporting materials, you grant ACM a non-exclusive, royalty-free, worldwide, perpetual license to use, edit, reproduce, and publish that content in connection with ACM’s mission, programs, and fundraising, unless you and ACM agree otherwise in writing.
Given the sensitive nature of ACM’s work with justice-involved individuals and at-risk youth, ACM will use reasonable discretion regarding the identification of program participants and will seek appropriate consent before publishing identifying photographs or stories of program participants, consistent with ACM’s internal privacy practices and any applicable grant or program confidentiality requirements.
8. Donations and Fundraising
ACM is a nonprofit organization, recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code—[insert EIN]. Donations made through the Site are processed by a third-party payment processor; ACM does not store your full payment card information. By making a donation, you represent that you are authorized to use the payment method provided.
Donations are generally non-refundable except as required by law or as determined by ACM in its sole discretion. Donors are responsible for consulting their own tax advisor regarding the deductibility of any contribution; ACM will provide a donation receipt but does not provide tax advice. ACM does not guarantee that any specific gift will be directed to a particular program unless the donation is expressly designated and accepted by ACM as a restricted gift in writing.
9. Volunteer Sign-Ups and Program Inquiries
The Site allows visitors to express interest in volunteering or to make general inquiries about ACM’s programs. Submitting a volunteer sign-up or inquiry form does not guarantee acceptance as a volunteer, enrollment in any ACM program, or the provision of any specific service. All volunteer engagement and program enrollment is subject to ACM’s separate screening, intake, eligibility, and (where applicable) background-check requirements, and is governed by separate agreements or program policies provided directly by ACM staff—not by these Terms.
10. No Guarantee of Outcomes
ACM’s programs address complex, community-level challenges, including violence prevention and reduction, conflict resolution, and support for justice-involved individuals. While ACM is proud of its history and outcomes, nothing on the Site—including statistics, testimonials, or program descriptions—constitutes a guarantee or warranty of any particular result for any individual, family, or community, and past results are not necessarily predictive of future outcomes.
11. Third-Party Websites
The Site may contain links to third-party websites, including social media platforms, partner and funder websites, news coverage, and the donation-processing platform. These links are provided for convenience only. ACM does not control, endorse, or assume responsibility for the content, privacy practices, or terms of any third-party site, and your use of any linked site is at your own risk and subject to that site’s own terms and policies.
12. Third-Party Technologies
The Site may use third-party tools and services to operate, including website hosting, analytics, email/newsletter delivery, forms, and payment processing (e.g., our donation platform). These providers may collect and process information (such as usage data or payment details) subject to their own terms and privacy policies. ACM is not responsible for the acts, omissions, availability, or security practices of these third-party providers, though we take reasonable care in selecting vendors that serve our mission and community responsibly.
13. Artificial Intelligence and Digital Content
ACM may use artificial intelligence or automated tools to assist in operating the Site (for example, to support chat features, draft or format content, or analyze site usage). Any AI-assisted content is reviewed for accuracy and consistency with ACM’s mission to the extent practicable, but AI tools can make mistakes or produce imperfect output. AI-assisted features on the Site are not a substitute for direct communication with ACM staff, and should not be relied upon for decisions about program eligibility, legal matters, or personal safety. If you notice inaccurate or concerning AI-generated content on the Site, please contact us using the information in Section 22.
14. Accuracy of Information
ACM strives to keep information on the Site—including program descriptions, statistics, staff information, and news—accurate and up to date. However, we make no representation or warranty that any information on the Site is complete, current, or error-free. Program details, contact information, staff, and initiatives may change without notice. If you rely on information from the Site for any purpose, we recommend confirming current details directly with ACM.
15. No Professional Advice
Content on the Site—including information about violence prevention, conflict resolution, reentry, mentoring, mental health, or community resources—is provided for general informational and educational purposes only. It is not legal, medical, mental health, social work, financial, or other professional advice, and does not create a counselor-client, social worker-client, attorney-client, medical, or other professional relationship between you and ACM or its staff.
If you or someone you know is in crisis or immediate danger, call 911 or the 988 Suicide & Crisis Lifeline.
Always seek the advice of a qualified professional with any questions regarding a personal legal, medical, mental health, or safety situation, and do not disregard or delay seeking professional guidance because of something you read on the Site.
16. Disclaimer of Warranties
THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ACM DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ACM, ITS BOARD MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, EVEN IF ACM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the fullest extent permitted by law, ACM’s total aggregate liability to you for any claim arising from or relating to the Site or these Terms will not exceed one hundred dollars ($100) or the amount you paid to ACM through the Site in the twelve (12) months preceding the claim, whichever is greater. As a nonprofit organization, ACM relies on charitable contributions and grant funding, and this limitation is intended to help preserve those resources for ACM’s mission.
Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.
18. Indemnification
You agree to defend, indemnify, and hold harmless ACM and its board members, officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit to or through the Site.
19. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Site will be governed by the laws of the District of Columbia, without regard to its conflict-of-laws principles.
Before initiating any formal legal proceeding, you agree to first contact ACM using the information in Section 22 so we can attempt to resolve the matter informally. Any legal action or proceeding not otherwise resolved will be brought exclusively in the state or federal courts located in the District of Columbia, and you consent to the personal jurisdiction of those courts.
20. Changes to These Terms
ACM may update these Terms from time to time to reflect changes in our programs, legal requirements, or Site functionality. When we make material changes, we will update the “Effective Date” at the top of this page and, where appropriate, provide additional notice on the Site. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
21. General Provisions
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and ACM regarding use of the Site and supersede any prior agreements on this subject.
No Waiver
ACM’s failure to enforce any provision of these Terms will not be considered a waiver of that provision or any other provision.
Assignment
You may not assign or transfer these Terms without ACM’s prior written consent. ACM may assign these Terms without restriction, including in connection with a merger, reorganization, or transfer of substantially all of its assets.
Force Majeure
ACM will not be liable for any failure or delay in Site operation resulting from causes beyond its reasonable control, including natural disasters, acts of government, labor disputes, internet or utility failures, or other events of force majeure.
Nonprofit Status
Nothing on the Site should be construed as a solicitation for donations in any jurisdiction where such solicitation would be unlawful. ACM will make good-faith efforts to comply with applicable state charitable-solicitation registration requirements.
